Terms of Service

These Terms of Service ("Terms") govern your use of BIMIHosting, a free BIMI logo hosting service operated by DuoCircle LLC ("BIMIHosting," "we," "us" or "our"), available at bimihosting.com (the "Site") and the associated services (the "Service").

By accessing or using the Service, you agree to be bound by these Terms. If you do not agree to these Terms, do not use the Service.

1. Service Description

BIMIHosting provides a free service for uploading, validating, and hosting BIMI-compliant SVG logos. The Service allows you to:

• Upload SVG logo files for BIMI compliance
• Validate SVG files against BIMI requirements
• Host your validated logos at publicly accessible URLs for use with BIMI DNS records

The Service is provided free of charge. We reserve the right to introduce paid features or tiers in the future, but any existing free functionality will remain available with reasonable notice of any changes.

2. Account Registration

To use the Service, you must create an account by providing a valid email address and password, or by signing in with a supported social login provider (Google, GitHub, or Microsoft).

• You must provide accurate and complete registration information.
• You are responsible for maintaining the confidentiality of your account credentials.
• You are responsible for all activities that occur under your account.
• You must notify us immediately of any unauthorized use of your account.
• You must be at least 18 years old to create an account.

3. Your Content

"Your Content" means any SVG logo files and related data that you upload to the Service.

• Ownership: You retain all ownership rights in Your Content. We do not claim any ownership of the logos you upload.
• License: By uploading content to the Service, you grant us a worldwide, non-exclusive, royalty-free license to host, store, serve, and make publicly available Your Content as necessary to provide the Service. This includes serving your logos via our CDN so that email clients can retrieve them for BIMI display.
• Public Hosting: You understand and agree that SVG logos uploaded to the Service will be hosted at publicly accessible URLs. This is fundamental to how BIMI works — email clients must be able to retrieve your logo via HTTPS.
• Representations: You represent and warrant that you own or have the necessary rights to upload Your Content, and that Your Content does not infringe any third party's intellectual property, privacy, or other rights.

4. Acceptable Use

You agree not to use the Service to:

• Upload content that infringes any third party's intellectual property rights
• Upload malicious files or content containing malware, viruses, or harmful code
• Impersonate any person or entity or misrepresent your affiliation
• Use the Service for any unlawful purpose
• Attempt to gain unauthorized access to the Service or its related systems
• Interfere with or disrupt the Service or its infrastructure
• Use automated tools to excessively scrape or access the Service
• Upload content that is obscene, defamatory, or otherwise objectionable
• Use the Service for purposes other than hosting BIMI-compliant logos

5. Service Availability

BIMIHosting is provided as a free service. While we strive to maintain high availability, we do not guarantee any specific uptime or service level. The Service may be subject to:

• Scheduled and unscheduled maintenance
• Temporary interruptions due to technical issues
• Changes to features or functionality

We will make reasonable efforts to provide advance notice of planned maintenance that may affect the availability of hosted logos.

6. Suspension and Termination

We may suspend or terminate your access to the Service at any time if:

• You violate these Terms or our Acceptable Use policy
• Your use of the Service poses a security risk
• We are required to do so by law
• We discontinue the Service (with reasonable notice)

You may terminate your account at any time by contacting us. Upon termination, we will delete your account data and hosted logos within a reasonable period.

7. Intellectual Property

The Service, including its design, features, and underlying technology, is owned by DuoCircle LLC and protected by intellectual property laws. These Terms do not grant you any rights to our trademarks, logos, or other brand features.

8. Privacy

Your use of the Service is subject to our Privacy Policy, which describes how we collect, use, and protect your information.

9. Disclaimer of Warranties

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, WHETHER EXPRESS, IMPLIED, STATUTORY, OR OTHERWISE. WE DISCLAIM ALL WARRANTIES, INCLUDING WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, AND NON-INFRINGEMENT.

We do not warrant that the Service will be uninterrupted, error-free, or secure, or that any defects will be corrected. We do not warrant that hosted logos will always be available or that the Service will meet your specific requirements.

10. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, DUOCIRCLE LLC AND ITS OFFICERS, DIRECTORS, EMPLOYEES, AND AGENTS WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS, DATA, USE, GOODWILL, OR OTHER INTANGIBLE LOSSES, ARISING OUT OF OR RELATED TO YOUR USE OF THE SERVICE, REGARDLESS OF THE THEORY OF LIABILITY.

OUR TOTAL LIABILITY FOR ALL CLAIMS ARISING OUT OF OR RELATED TO THESE TERMS OR THE SERVICE WILL NOT EXCEED ONE HUNDRED U.S. DOLLARS (US$100).

These limitations apply even if we have been advised of the possibility of such damages and even if a limited remedy fails of its essential purpose. Some jurisdictions do not allow the exclusion or limitation of certain damages, so some of the above limitations may not apply to you.

11. Indemnification

You agree to indemnify, defend, and hold harmless DuoCircle LLC and its officers, directors, employees, and agents from and against any claims, damages, losses, and expenses (including reasonable attorneys' fees) arising out of or related to:

• Your use of the Service
• Your violation of these Terms
• Your Content, including any claim that Your Content infringes a third party's rights

12. Changes to These Terms

We may update these Terms from time to time. We will notify you of material changes by posting the updated Terms on this page and updating the "Effective as of" date. Your continued use of the Service after changes take effect constitutes acceptance of the updated Terms.

13. Governing Law

These Terms are governed by and construed in accordance with the laws of the State of New York, without regard to its conflict of law principles. Any disputes arising out of or related to these Terms will be resolved in the courts located in New York County, New York.

14. General

• Entire Agreement: These Terms, together with the Privacy Policy and Cookie Notice, constitute the entire agreement between you and DuoCircle LLC regarding the Service.
• Severability: If any provision of these Terms is held unenforceable, the remaining provisions will continue in effect.
• Waiver: Our failure to enforce any provision of these Terms will not constitute a waiver of that provision.
• Assignment: You may not assign your rights under these Terms without our prior written consent. We may assign our rights without restriction.
